Filing 86 MEMORANDUM AND ORDER denying 66 Motion for Summary Judgment; granting in part and denying in part 76 Motion for Summary Judgment. Plaintiff's motion for summary judgment (Dkt. No. 66) is denied. Because the record is insufficient to dete rmine whether defendants have violated C.M.'s stay-put rights under the IDEA or failed to enforce the SRO's March 26, 2015 order, defendants' motion for summary judgment (Dkt. No. 76) is denied with respect to those two claims and granted in all other respects. (As further set forth in this Order.) (Signed by Judge P. Kevin Castel on 3/30/2017) (cf) |
