June 7, 2016 Opinion or Order Filing 48 ORDER TO SHOW CAUSE WHY ACTION SHOULD NOT BE DISMISSED WITH PREJUDICE: Presently pending is a motion made by plaintiff to dismiss this action without prejudice pursuant to Fed. R. Civ. P. 41(a)(2). Defendant opposes the motion insofar as it seeks dismissal without prejudice. Defendant argues, in a letter dated May 26, 2016, that National Union has fulfilled it indemnity obligations to plaintiff under the policy, so dismissal should be with prejudice. Plaintiff has not responded to this letter. I gather that the underlying action has been resolved, though I have no details. Plaintiff is ordered to show cause why this motion should not be converted to a motion to dismiss with prejudice, on the ground that National Union has complied with its obligation to indemnify under the policy in suit. Plaintiff must explain why there is something left to this case by June 15, 2016. If the court does not have a response to this order to show cause by 5 PM on that date, I will convert the motion and dismiss the action with prejudice. (As further set forth in this Order.)
