Colvin. For the reasons discussed above, defendant's motion for judgment on the pleadings is GRANTED and plaintiff's cross-motion for judgment on the pleadings is DENIED. September 18, 2015 Opinion or Order Filing 4 MEMORANDUM OPINION & ORDER: All actions in this Court are governed by the Federal Rules of Civil Procedure. Rule 8(a) requires that pleadings contain "a short and plain statement of the claim showing that the pleader is entitled to relief." ; Fed. R. Civ. P. 8(a). For particularly deficient pleadings, a court may raise such issues sua sponte. Salahuddin v. Cuomo, 861 F.2d 40, 42 (2d Cir. 1988). Plaintiff has not satisfied the requirements of Fed. R. Civ. P. 8(a)(2) as explained in Bell Atlantic Corp. v. Twombly, 550 U.S. 544 (2007) and Ashcroft v. Iqbal, 556 U.S. 662 (2009). Plaintiff is directed to amend her Complaint to include a brief statement of facts establishing the reasons why this Court should find that the defendant� 39;s decision was wrong. Plaintiff shall file an amendment within thirty days of the date of this order. Failure to amend will result in dismissal. The Clerk of Court is directed to amend the caption of the complaint to list "Carolyn Colvin, Com missioner, Social Security Administration" as the defendant to this action.
