P. 12(b)(6) filed by Colin Austin, Anthony Denatale, Michael Liberatore, Howard Redmond, 46 MOTION for Judgment on the Pleadings filed by City of New York: For the foregoing reasons, the complaint against Defendan t Lang is dismissed due to failure to serve. The motion by Defendants Austin, Denatale and Liberatore to dismiss the claim against them as time-barred is GRANTED, and the corresponding motion by Defendant Redmond is DENIED. The City's motion for judgment on the pleadings is GRANTED. The Clerk of the Court is directed to remove Docket Nos. 46 and 58 from the Court's list of pending motions.
