MEMORANDUM AND OPINION re: 52 MOTION for Summary Judgment . filed by Lafarge Canada Inc., Lafarge North America, Inc., 53 MOTION for Summary Judgment . filed by AIG Insurance Company of Canada, Lexington Insurance Company, American Home Assurance Company. For the reasons stated above, the Court finds that neither the duty-to-defend dispute nor the duty-to-indemnify dispute is presently suitable for discretionary DJA jurisdiction. This case is hereby stayed . The parties are directed to meet and confer about the appropriate length of the stay and what progress in the Canadian litigation might alleviate the Court's concerns outlined in this Opinion. The parties are further ordered to appear at a conference on the matter on April 25, 2018 at 11:00 a.m., and to notify the Court on the results of their discussions one week prior.
