MEMORANDUM OPINION re: 56 MOTION for Summary Judgment filed by Kirl C Francis, Faust Goetz Schenker & Blee, LLP. The equitable doctrine of judicial estoppel prevents Molina, as the nominal plaintiff in this case, from making the arguments necessary for him to prevail.
