March 23, 2017 Opinion or Order Filing 74 OPINION & ORDER re: 52 AMENDED MOTION for Attorney Fees (to assert Charging Lien Pursuant to N.Y. For the reasons set forth above, IT IS HEREBY ORDERED that LM's motion for a charging lien pursuant to Section 475 (Doc. No. 52) is GRANTED, and that LM is entitled to r ecover a 15% pro rata share of the attorney's fees collected out of any settlement. IT IS FURTHER ORDERED that Plaintiff's motion to redact is GRANTED, and LM's motion to redact exhibit 7 of its opening declaration is also GRANTED. (Doc. Nos. 55, 65.) IT IS FURTHER ORDERED that LM shall file a letter brief and declaration no later than March 29, 2017 explaining why its July 26, 2016 reply declaration and Exhibits 1 and 7 of its July 28, 2016 reply declaration s hould remain under seal. (Doc. Nos. 71, 73-1, 73-7.) The Clerk is respectfully directed to terminate the motions pending at docket numbers 52, 55, and 65. In light of the parties' representation that they have reached a settlement in principl e, IT IS FURTHER ORDERED that this case is dismissed with prejudice but without costs. However, within thirty days of the date of this Order, any party may send a letter requesting to restore this action to the docket with an explanation for the request.
