OPINION AND ORDER re: 49 MOTION to Dismiss . filed by Village Care Of New York, Inc., Village Diagnostic Treatment Center. For the foregoing reasons, Defendants' motion for judgment on the pleadings, (Doc. 49), is GRANTED. T o the extent Plaintiff's allegations can be construed to give rise to state law claims, I decline to exercise jurisdiction over such claims and they are dismissed without prejudice to filing those claims in state court. The Clerk of Court is respectfully directed to enter judgment for Defendants and close the case. SO ORDERED. (Signed by Judge Vernon S.
