September 29, 2017 Opinion or Order Filing 34 MEMORANDUM & OPINION re: 30 FIRST MOTION to Dismiss the Amended Complain filed by New York City Department Of Education, Kaye Houlihan, Dorish Munoz Fuentes. For the reasons stated above, it is hereby ordered that Defendants' ; motion to dismiss is GRANTED IN PART and DENIED IN PART. Defendants' motion with respect to Plaintiff's retaliation, hostile work environment, constructive discharge, procedural due process, and municipal liability claims pursuant to & #167; 1983 is GRANTED. Defendants' motion with respect to Plaintiff's religious and age discrimination claims pursuant to § 1983 is DENIED. Plaintiff's claims pursuant to the NYSHRL and the NYCHRL are time-barred and dismissed with prejudice. The parties are instructed to meet and confer regarding the scheduling of discovery and should submit a proposed case management plan and scheduling order on or before October 20, 2017.
