Filing 63 OPINION AND ORDER re: 43 MOTION for Summary Judgment filed by Warren Zyzman, A.R.E.B.A. Casriel, Inc. For the foregoing reasons, Defendants' motion for summary judgment is GRANTED IN PART and DENIED IN PART. The Court grants summary judgment as to all claims except Plaintiff's claims against ACI for failure to accommodate her disability under the ADA and the NYCHRL. The Clerk of Court is directed to terminate the motion at Docket Entry 43. The parties are direct ed to appear for a conference on September 27, 2017, at 11:00 a.m., in Courtroom 618 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, New York 10007, to schedule a trial in this matter. The Court certifies under 28 U.S.C. § 1915 (a)(3) that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (As further set forth in this Order.)
