December 21, 2017 Opinion or Order Filing 98 OPINION AND ORDER: re: 88 MOTION to Dismiss Plaintiff's Complaint and/or for Summary Judgment filed by Sunny Kulathakal. For the foregoing reasons, Kulathakal's motion to dismiss is GRANTED in part and DENIED in part. Specifically, c laims relating to the lawsuit filed in India are dismissed, while claims relating to the press statements survive. Kulathakal's motion for summary judgment is DENIED as moot with regard to the Indian lawsuit, and DENIED without prejudice to rene wal with regard to the press statements. All claims against Tehelka News are dismissed. Kulathakal is directed to file an answer to the surviving claims by January 12, 2018. In addition to informing the Court about the status of the suit against Gadh avi (see supra Part V), Ramsaran is directed to inform the Court as to Kulathakal's country of citizenship (see supra footnote 1) via ECF letter, which shall be due on January 12, 2018. March 30, 2017 Opinion or Order Filing 86 OPINION AND ORDER: Motions terminated: 62 FIRST MOTION to Dismiss Plaintiff's Complaint. filed by Ram Gadhavi, 83 MOTION for Default Judgment as to SUNNY KULATHAKAL filed by Ashook Ramsaran, 65 FIRST MOTION t o Dismiss for Lack of Jurisdiction and Insufficient Service of Process filed by DNA News, 28 MOTION to Dismiss the Complaint and/or MOTION for Summary Judgment ORAL ARGUMENT IS REQUESTED filed by Thomas Abraham. For the foregoing reasons, Defendant Abrahams motion to dismiss is GRANTED, and his motion, in the alternative, for summary judgment is DENIED AS MOOT. Defendant Gadhavis motion to dismiss is GRANTED IN PART and DENIED IN PART. The motion for default judgment against Kulathakal is DENIED, and Kulathakals request to vacate the Certificate of Default against him is GRANTED. DNA Newss motion to dismiss is also GRANTED. The claims against APN News are hereby dismissed for failure to prosecute. Accordingly, the Clerk of Court is directed to close the motions at Docket Numbers 28, 62, 65, and 83. (Signed by Judge J.
