Filing 57 MEMORANDUM OPINION AND ORDER re: 40 MOTION to Dismiss filed by EmblemHealth, Inc., Health Insurance Plan of Greater New York. The Court has considered all of the arguments of the parties. To the extent not specifically add ressed, the arguments are either moot or without merit. Therefore, for the reasons explained above, the defendants' motion to dismiss the first and third causes of action is granted and those claims are dismissed without prejudice. The motion to dismiss the second and fourth causes of action is denied. The Clerk is directed to close ECF No. 40. (As further set forth in this Memorandum Opinion and Order.)
