OPINION AND ORDER re: 17 CROSS MOTION for Judgment on the Pleadings filed by Commissioner of Social Security 15 MOTION for Judgment on the Pleadings filed by David Paredes. Paredes moves pursuant to Fed. R. Civ. P. 1 2(c) for an order reversing the Commissioner's decision or remanding for further proceedings; the Commissioner cross-moves pursuant to Fed. R. Civ. P. 12(c) for an order affirming her decision. The parties have consented to this Court's jurisdiction for all purposes pursuant to 28 U.S.C. § 636(c). (As further set forth in this Order.) For the foregoing reasons, the Commissioner's motion is DENIED, plaintiff's motion is GRANTED, and this action is REMANDED to the Commissioner for further proceedings consistent with this Opinion and Order.
