March 31, 2020 Opinion or Order Filing 203 MEMORANDUM DECISION AND ORDER adopting 193 Report and Recommendations re: 168 Motion for Summary Judgment: Defendants' objections are OVERRULED, and Magistrate Judge Parker's Report is ADOPTED. Defendants' motion for summary judg ment, (ECF No. 168) is DENIED as to Plaintiffs alleged (1) NYCHRL claim against HHS and Motal for their discriminatory failure to promote Plaintiff to Social Worker Level III in the MCU in 2014; (2) Title VII and NYCHRL claims against HHS for its dis criminatory failure to promote him to Social Worker Level III in the MICA program in 2015; (3) Title VII and NYCHRL retaliation claims against HHC and Motal with respect to the denial of his promotions to the MCU and MICA positions in 2014, and again st HHC only with respect to the denial of his promotion to the MICA position in 2015; (4) NYCHRL retaliation claim against HHC and Motal with respect to the verbal counseling, removal of his PASA supervisory duties, and delay in his promotion to Soci al Worker Level II; and (5) Title VII and NYCHRL retaliation claims against HHC and Motal with respect to his transfer to the Inpatient Psychiatric Unit, denial of the ability to work with the substance abuse community, assignment of additional work, refusal of his request to transfer out of the Psychiatric Unit or to another hospital, denial of weekly clinical supervision and of requested vacation time, threats of discipline for fabricated attendance issues, and failure to investigate his claims of discrimination. (See id at 64-66.) Defendants' motion is GRANTED as to all other claims against them. The Clerk of Court is directed to close the motion accordingly. (Signed by Judge George B. Nevertheless, the parties have filed letter motions requesting that Erickson's, Horowitz's, Burton-Jones 9;s, and Cosme's resumes be filed under seal. (Doc. Nos. 167 and 179.) For the reasons set forth below, the parties' request is GRANTED IN PART and DENIED IN PART as further set forth herein. As such, the Court hereby orders the partie s to redact Erickson's, Horowitz's, Burton-Jones, and Cosme's personal information i.e. home addresses, phone numbers, and email addresses from the resumes/job applications at issue, and file the redacted version of those exhibits on the docket by no later than March 18, 2020. July 31, 2017 Opinion or Order Filing 58 MEMORANDUM DECISION AND ORDER adopting 48 Report and Recommendations re: 40 Motion to Dismiss: Plaintiff Alexander Anderson, an employee of Lincoln Hospital, filed this action against Defendants the City of New York, the New York City Health a nd Hospital Corporation ("HHC"), Miriam Carasa, Abdul Mondul, David Nadal, Athena Motal, Milly Toro, Nicole Robinson, and Maria Kazaki-Maher, claiming that Defendants discriminated against him, subjected him to a hostile work environment, a nd retaliated against him, in violation of the Age Discrimination in Employment Act of 1967, 29 U.S.C. §§ 621 et seq.; Title VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 2000e et seq. ("Title VII"); 42 U.S.C. § 1981; 42 U.S.C. § 1983 ("Section 1983"); the New York City Human Rights Law, New York City Admin. Code §§ 8-101 et seq. ("NYCHRL"); and Article I, §§ 6, 8, and 11 of the New York Constitution. (First Am. Compl. ("FAC"), ECF No. 35.) Defendants moved to dismiss the FAC pursuant to Rules 4(m) and 12(b)(4), (5), and (6) of the Federal Rules of Civil Procedure. (Defs.' Mot. Dismiss ("Mot."), ECF Nos. 40--42.) This matter was refe rred to Magistrate Judge Katharine H. Parker on March 2, 2016. (ECF No. 3.) Having reviewed Magistrate Judge Parker's Report and Recommendation, this Court overrules Plaintiff's objections and adopts the Report in full. Defendants' Mot ion to Dismiss is GRANTED in part, dismissing: (i) all counts as to New York City; (ii) Counts 5, 6, 7, 8, 10, 11, 12, and 13 as to all Defendants; (iii) Count 9 as to all Defendants except Individual Defendants Carasa, Mondul, Mota!, and Robinson; (iv) Count 18 as to all Defendants except HHC; and (v) Plaintiff's claims for punitive damages as to HHC.
