Filing 139 MEMORANDUM OPINION AND ORDER re: 94 MOTION for Summary Judgment filed by Barbara Sampson, The City Of New York, Timothy Kupferschmid. For the foregoing reasons, summary judgment is DENIED as to the Monell claim, the retaliation claims with respect to the CFS Statements and the CFS Votes, and the age discrimination claim. Summary judgment is GRANTED as to the § 995-a claim and the retaliation claim concerning the 2013 Statement to Dr. Sampson. The Clerk of Court is directed to terminate the motion pending at Dkt.
