Filing 33 OPINION & ORDER re: 13 MOTION to Dismiss Notice of Motion to Dismiss. filed by Local 32BJ SEIU, 18 MOTION to Dismiss . filed by ABM Industries, Inc. For the foregoing reasons, Local 32BJ's motion is granted in it s entirety. ABM's motion is granted with respect to Plaintiff's NYSHRL and NYCHRL claims, but denied with respect to aspects of Plaintiff's Title VII discrimination and retaliation claims, as detailed above. The NYSHRL and NYCHRL cla ims against both Defendants are dismissed with prejudice. The Clerk of Court is respectfully directed to terminate the motions pending at Docket Numbers 13 and 18.
