Filing 51 MEMORANDUM AND OPINION: For the reasons stated here, the Individual Defendants' motion for partial dismissal, (Doc. 40), is GRANTED IN PART and DENIED IN PART. Count II is dismissed in its entirety. Counts I, III and IV are dismissed in part, as they fail to state a claim for: (1) hostile work environment against the Individual Defendants, (2) discrimination and retaliation under § 1983 and the NYSHRL against the Individual Defendants based on Plaintiff's July 2013 Suspension ; (3) discrimination and retaliation under § 1983 and the NYSHRL against Defendant O'Brien based on the decision to place Plaintiff on probation; (4) discrimination and retaliation under § 1983 and the NYSHRL against Defendant O 9;Brien based on the June 2015 Termination; (5) retaliation under § 1983 and the NYSHRL against Defendant Loehr; and (6) sex discrimination under the NYSHRL against the Individual Defendants. The parties are instructed to meet and confer regar ding the scheduling of discovery and should submit a proposed case management plan and scheduling order on or before October 27, 2017.
