The Court having been advised that all claims asse1ied herein have been settled, it IS ORDERED, that the Motion in Limine (ECF No. 58) is denied as moot. The Clerk of the Court requested to terminate the motion ( ECF No. 58). It is further ORDERED, that the jury selection/trial scheduled to commence on February 24, 2020 is cancelled. It is further ORDERED, that the above-entitled action be and hereby is discontinued, without costs to either party, subject to reopening should the settlement not be consummated within forty five (45) days of the date hereof. The parties are advised that if they wish the Court to retain jurisdiction in this matter for purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the next 45 days with a request that the agreement be "so ordered" by the Court. Filing 51 OPINION and ORDER: For the foregoing reasons, Defendants' motion for summary judgment is DENIED in part and GRANTED in part. The Court grants Defendants' motion for summary judgment to the extent of dismissing all of Plaintiffs NYHRL sta te law claims. Defendants' motion for summary judgment seeking to dismiss Plaintiffs discrimination claims regarding the 2014 denial of tenure is granted as against Dr. Chase and denied as against GCSD. Defendants' motion for summary judg ment seeking to dismiss Plaintiffs discrimination claims regarding the denial of tenure in 2015 is denied. Accordingly, the Court respectfully directs the Clerk of the Court to terminate the motion at ECF No. 40. The parties are directed to appear in court on March 14, 2019 at 11 :30 a.m., for a pre-trial conference.
