Filing 12 OPINION AND ORDER adopting 11 Report and Recommendation granting re: 8 MOTION to Dismiss filed by Christopher Shanahan. Careful review of the thorough and well-reasoned Report reveals that there is no facial error in its co nclusion, and, indeed, that it is clearly correct. The parties' failure to file written objections precludes appellate review of this decision. See Caidor v. Onondaga County, 517 F.3d 601, 604(2d Cir. 2008); Small v. Sec'y of Health & Hum an Servs., 892 F.2d 15, 16 (2d Cir. 1989) (per curiam). Indeed, the Report specifically states that "failure to file timely objections will preclude appellate review." Report at 6. The Report, which is incorporated by reference herein, is therefore adopted without modification. Respondents' motion to dismiss the petition for habeas corpus is granted.
