Filing 121 MEMORANDUM & OPINION re: 52 MOTION to Compel Arbitration and. MOTION to Dismiss Plaintiffs' Class Action Complaint filed by PQ Operations Inc., PQ 933 Broadway, Inc., PQ Central Park, PQ New York Inc., 87 MOTION for Leave to File an Amended Complaint filed by Taniqua Brown, Cuneyt Kutluca, Angelica George. For the reasons set forth above, Defendants' motion to compel arbitration, (Doc. 52), is GRANTED, and Plaintiffs' mo tion for leave to file an amend complaint, (Doc. 87), is DENIED as futile. In light of the fact that no party has requested a stay pending arbitration, see Katz v. Cellco P'ship, 794 F.3d 341, 345 (2d Cir. 2015), the case is dismissed, see Lawrence v. Sol G. Atlas Realty Co., 841 F.3d 81, n.1 (2d Cir. 2016). In light of the fact that the motions were decided on the parties' submissions, Defendants requests for oral argument, (Docs. 56, 93), are DENIED as moot.
