November 21, 2023 Opinion or Order Filing 293 ORDER On November 11, 2023, the parties filed a proposed stipulation and order seeking extensions of the expert discovery deadlines. The deadline for expert discovery is extended to Friday, February 16, 2024. The deadline for opening expert report s is extended nunc pro tunc to Friday, December 15, 2023; and the deadline for rebuttal expert reports is extended nunc pro tunc to Thursday, February 1, 2024. Expert depositions shall be completed by February 16, 2024. The parties shall comply wi th Judge Marreros Individual Rules regarding summary judgment briefing. September 26, 2023 Opinion or Order Filing 290 ORDER: Accordingly, that provision of the Order at ECF No. 289 should be disregarded. Instead, the parties' pre-motion letters regarding Summary Judgment shall be addressed to Judge Marrero, and those letters shall request a pre-motion conf erence. If Judge Marrero chooses to schedule a conference, he will do so at his convenience, regardless of any agreement between the parties. Judge Marrero also may revise the parties' agreed-upon schedule for Summary Judgment briefing. May 17, 2023 Opinion or Order Filing 274 ORDER: As discussed at the May 17, 2023 Case Management Conference: Plaintiff shall attempt to resolve the document discovery dispute with AMZM, and if the issue cannot be resolved by May 24, 2023, Plaintiff and AMZM shall file a letter on ECF out lining the remaining dispute. Because AMZM is not a party to this action, counsel for Defendants (who also represent AMZM) shall ensure AMZM is aware of this order. Additionally, the Court assumes that Defendants will not be moving to amend their counterclaims in this action but will rather seek to amend the claims in the Delaware action. In the event Defendants instead seek to amend their counterclaims in this action, they shall file a letter by May 24, 2023 that proposes a briefing schedule for the motion. (ECF No. 202.) Pursuant to the Bankruptcy Code, the initiation of the bankruptcy proceedings resulted in an automatic stay of the litigation in this Court. 11 U.S.C. §362(a). However, the docket does not indicate this case is currently stayed. As suc h, the Clerk of Court is directed to enter a stay of this case on the electronic docket.
