OPINION & ORDER: For the reasons set forth above, Kortbawi's Petition is DENIED. Because Kortbawi has not made a substantial showing of the denial of a constitutional right, a certificate of appealability shall not issue. See 28 U.S .C. § 2253(c)(2). The Clerk of Court is respectfully directed to terminate the Petition at ECF No. 1 and to close civil case number 16-CV-4934. Any pending motions in case number 16-CV-4934 are moot. SO ORDERED.
