Filing 23 ORDER. The Court's dutiful reexamination and recitation of the Pioneer factors does not alter its conclusion that, as the Second Circuit has found in similar cases, Plaintiffs nearly yearlong failure to prosecute this case and respond to Court orders was inexcusable. See, e.g., Pollard, 452 F. App'x at 40-41; Canfield v. Van Atta Buick/GMC Truck, Inc., 127 F.3d 248, 250 (2d Cir. 1997). To the extent that Plaintiff has therefore been deprived of a potentially viable claim against Defendants, he may have a remedy in the form of a malpractice suit against his attorneys, but that does not entitle him to resurrect this long-neglected litigation at the expense of Defendants and this Court. See Link v. Wabash R. Co., 370 U.S. 626, 634 n.10 (1962) ("If an attorney's conduct falls substantially below what is reasonable under the circumstances, the client's remedy is against the attorney in a suit for malpractice. But keeping this suit alive merely because [P]laintiff should not be penalized for the omissions of his own attorney would be visiting the sins of [P]laintiff's lawyer upon the [D]efendant[s].") Accordingly, for the reasons set forth above, Plaintiff's Rule 60(b)(1) motion is DENIED. SO ORDERED. (Signed by Judge Richard J. Sullivan on 7/23/18) (yv) |

Filing 19 ORDER denying #17 Letter Motion to Reopen Case. Plaintiff's request to reopen this case eleven months after the Court dismissed it for failure to prosecute is DENIED. Plaintiff's failure to respond to Court orders or to check the docket sheet of his own case for nearly a year is not the equivalent of missing a filing deadline and does not constitute the kind of mistake, inadvertence, excusable neglect, or other exceptional circumstance that warrants relief under Rule 60. See, e.g., Pollard v. Does, 452 F. App'x 38, 40 - 41 (2d Cir. 2011) (upholding dismissal for failure to prosecute where plaintiff failed to comply with court orders and to prosecute his case for more than a year); Canfield v. Van Atta Buick/GMC Truck, Inc., 127 F.3d 248, 250 (2d Cir. 1997) ("failure to follow the clear dictates of a court rule" not excusable neglect). Since the Court dismissed this case without prejudice, Plaintiff is of course free to re-file, subject to the applicable statute of limitations. (Signed by Judge Richard J.
