It is hereby ORDERED, that the Petition, insofar as it seeks confirmation of that portion of the Final Award that awards to Milestone non-monetary relief, is hereby granted; and it is further ORDERED, that in accordance with the Final Award, OnSSI shall cease and refrain from distributing, including by means of reproducing for download on OnSSI's website, software included in the XProtect Device Pack 8.2; and it is further ORDERED, that in accordance with the Final Award, OnSSI shall cease and refrain from distributing, including by means of reproducing for download on OnSSI's website, software included in any Milestone XProtect Device Packages released after October 1, 2015; and it is further ORDERED, that the Clerk of the Court is hereby directed to enter judgment hereon. ORDER: Having reviewed the parties' letters dated August 1 and 2, 2016, it is ORDERED that Respondent's request to reconsider the Court's order denying Petitioner's motion to file a redacted petition and memorandum of law and to seal the arbitration award, ECF No. 15, is GRANTED. The arbitral decision may not be a "judicial document subject to the right of public access" and may be of little "value...to those monitoring the federal courts" if, as Respondent plans to contend, it is not a final and binding award. Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 119 (2d Cir. 2006); cf Clearwater Ins. Co. v. Granite State Ins. Co., No. 15 Civ. 165, 2015 WL 500184, *3 (S.D.N.Y. Feb. 5, 2015) (describing as judicial documents those filed in connection with a final arbitration award). Accordingly, the request to file the redacted documents and to file the arbitration award under seal is provisionally GRANTED pending further consideration of Respondent's contention that confirmation and enforcement of the award is premature.
