Filing 34 OPINION & ORDER re: 26 MOTION to Dismiss the Amended Class Action Complaint filed by IRSA Inversiones Y Representaciones Sociedad Anonima, Cresud Sociedad Anonima Comercial, Inmobiliaria, Financiera Y Agropecuaria. For t he foregoing reasons, IRSA and Cresud's motion to dismiss is GRANTED. The Clerk of Court is respectfully directed to terminate the pending motion, (Doc. 26), and enter judgment for IRSA and Cresud. With regard to the Individual Defendants , as detailed above, Plaintiff's letter regarding service against the Individual Defendants is due on or before September 24, 2018. The parties are also directed to file a joint letter in the Tomka Action on or before October 5, 2018 that (i) addresses the effect of this Opinion & Order on the claims alleged in and status of that case and (ii) proposes next steps.
