Filing 42 MEMORANDUM OPINION AND ORDER re: 25 FIRST MOTION for Summary Judgment . filed by Downey, The County of Westchester. Defendants' motion for summary judgment is DENIED without prejudice to renewal on the same or other grounds on ce discovery is completed. A civil case discovery plan and scheduling order will be docketed separately. The Clerk is instructed to (i) terminate the motion (Doc. #25) and (ii) mail a copy of this Order to plaintiff at the address that appears on th e docket. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
