October 13, 2021 Opinion or Order Filing 465 FINAL APPROVAL ORDER AND JUDGMENT: Upon consideration of the Plaintiffs' Unopposed Motion for Final Approval of the Settlement of the above-referenced litigation under the terms of a Class Action Settlement Agreement dated May 21, 2021, (the "Settlement Agreement"), the Court hereby orders and adjudges as follows: For purposes of this Final Order and Judgment, capitalized terms used herein have the definitions set forth in the Settlement Agreement, which is incorporated herei n by reference. The Motion for Final Approval of the Settlement Agreement is hereby GRANTED, the Settlement of the Litigation is APPROVED as fair, reasonable, and adequate to the Plans and the Settlement Class, and the Settling Pai1ies are hereby directed to take the necessary steps to effectuate the terms of the Settlement Agreement. Within three (3) calendar days following the issuance of all settlement payments to Class Members, the Settlement Administrator shall prepare and provide to Class Counsel and Defense Counsel a list of each person who was issued a settlement payment and the amount of such payment. Upon entry of this Order, all Class Members shall be bound by the Settlement Agreement (including any amendments) and by thi s Final Order. (And as further set forth herein.) SO ORDERED. April 1, 2021 Opinion or Order Filing 433 ORDER denying 428 Motion re: 428 MOTION For Ruling Under Rule 43 Regarding Witnesses Avoiding In-Person Testimony . Plaintiffs' request that the Court order Defendant to submit in camera the current and anticipated vac cination status of each witness seeking to avoid in-person testimony and the particular reasons that he or she would prefer not to attend or would be uncomfortable testifying in person, (ECF No. 428), is DENIED. The COVID-19 pandemic itself does no t alone constitute "good cause" or "compelling circumstances" to allow witnesses to testify remotely rather than personally in court. Fed. R. Civ. P. 43. All witnesses designated to testify at trial, who are within the subpoena power of this Court, must testify in-person unless the parties agree otherwise, or the Court finds good cause in compelling circumstances to permit a particular witness to testify by contemporaneous transmission from a different location.
