Filing 78 OPINION AND ORDER.....The defendants motions to dismiss are granted. Because none of the plaintiffs claims survive the motion to dismiss, because the plaintiffs have not moved for entry of default against the corporate defendants, and because the an alysis in this Opinion applies equally to the claims brought against BondFactor and ButcherMark, the claims against BondFactor and ButcherMark are also dismissed with prejudice. The Clerk of Court shall enter judgment for the defendants and close the above-captioned consolidated cases. (Signed by Judge Denise L. Cote on 8/2/2017) Filed In Associated Cases: 1:16-cv-07751-DLC, 1:16-cv-08091-DLC Copy Mailed By Chambers to George Butcher. (gr) |
