Filing 41 OPINION AND ORDER re: 35 MOTION for Attorney Fees and Expenses filed by Norman Roberts.For the reasons set forth above, Plaintiff's motion for an award of attorneys' fees is DENIED. The Clerk of Court is directed to te rminate Docket Entry 35. Further, because Plaintiff has previously advised the Court that the reasons for his litigation have been mooted (see Dkt. #32 at 2 ("The parties agree that, as a result of the Company's decision to term inate the Consent Solicitation, Plaintiff's claims in this Action are moot.")), the Court DISMISSES this action. The Clerk of Court is directed to terminate all pending motions, adjourn all remaining dates, and close this case.
