July 17, 2023 Opinion or Order Filing 127 ORDER On July 17, 2023, it was reported to me that the parties did not reach a settlement in this case. It is hereby: ORDERED that counsel for all parties appear for a pretrial conference on July 26, 2023 at 1:00pm in Courtroom 518 of the Thurgood Marshall United States Courthouse, 40 Foley Square, New York, New York. Counsel should be prepared to discuss potential trial dates. September 10, 2018 Opinion or Order Filing 34 OPINION & ORDER re: 19 MOTION to Dismiss the Complaint filed by New York City Housing Authority, Michael Kelly, Brian Clarke, 22 MOTION to Dismiss the complaint filed by City Of New York, Melissa Mark-Viverito. For the foregoing reasons, Defendants' motions to dismiss are GRANTED in part and DENIED in part. Defendants' motions to dismiss are GRANTED with respect to: (1) all Claims for Relief against the City; (2) the First, S econd, Fifth, Sixth, Seventh, Eighth, and Ninth Claims for Relief against the Council Speaker; (3) the Fifth, Sixth, Seventh, Eighth, and Ninth Claims for Relief against NYCHA; and (4) the Fifth and Ninth Claims for Relief against Clarke and Ke lly. Defendants' motions to dismiss are DENIED with respect to: (1) the Third and Fourth Claims for Relief against the Council Speaker; (2) the First, Second, Third, and Fourth Claims for Relief against NYCHA; and (3) the First, Second, Thi rd, Fourth, Sixth, Seventh, and Eighth Claims for Relief against Clarke and Kelly. Defendants shall file their answers to the Amended Complaint within twenty-one (21) days of the entry of this Opinion & Order. The Clerk of Court is respectfully directed to terminate Defendant City of New York. The Clerk of Court is also respectfully directed to terminate the open motions at Docket Nos. 19 and 22.
