Filing 38 MEMORANDUM OPINION AND ORDER re: 13 filed by The City of New York, New York City Police Department. For the foregoing reasons, Defendants' motion to dismiss the Complaint is granted. The scheduled July 10, 2018, initial pre-trial conf erence is adjourned to Friday, October 26, 2018, at 10:00 a.m. as a control date. Plaintiff may make a motion for leave to replead the claims and requests for relief asserted in his First through Seventh Causes of Action. Any such motion must be f iled by Thursday, July 19, 2018, and must be accompanied by a proposed Amended Complaint, a blacklined version reflecting changes from the Complaint, and a memorandum of law in support of the motion. Failure to make such a timely motion, or denial of the motion as futile, may result in dismissal with prejudice of the Amended Complaint in its entirety, without further advance notice.
