Date Filed Document Text
January 24, 2020 Opinion or Order Filing 82 ORDER: The motion to amend the JPTO to change the theory of liability against Roberto Gutierrez is denied. A direct excessive force claim is different from a supervisory liability claim. Today is the last business day before trial; it is too late to change the theory of liability. This defendant will be prejudiced by a change of theory at the eleventh hour. Accordingly, the theory may not be changed at this late date. (Signed by Judge Loretta A. Preska on 1/24/2020) (ks)
January 22, 2020 Opinion or Order Filing 74 ORDER terminating 62 Motion in Limine; terminating 63 Motion in Limine: At the final pretrial conference held on January 13, 2020, the parties agreed and the Court ordered that: 1) Plaintiff's municipal liability claim is dismissed and the caption should be amended to remove the City of New York ("City") as a defendant, and as further set forth in this order. At the pretrial conference, the Court reserved ruling on the parties' remaining motions in limine. The Court now rules on those motions as further set forth in this order. The Clerk of the Court is directed to close the open motions [dkt. nos. 62, 63]. (Signed by Judge Loretta A. Preska on 1/22/2020) (jwh)
