Third-Party Defendants' motion after conversion to a motion for summary judgment - is GRANTED to the extent that Geodis see ks damages and DENIED to the extent that it seeks indemnification and contribution. It follows that their request for attorneys' fees, costs, and expenses - a request that rests on the assertion that Geodis's claims are clearly timely barre d under the Montreal Convention (see El Al Mem. 9) - is also DENIED. All dates and deadlines, including the January 20, 2018 fact discovery deadline, the January 22, 2018 pretrial conference, and the March 15, 2018 expert discovery deadline, remain in effect.
