OPINION AND ORDER: re: 26 MOTION to Remand to State Court and for Attorney's Fees and Costs filed by Derrick Burton. For the foregoing reasons, Plaintiff's motion to remand is GRANTED. The Clerk of the Court is directed to close the mot ion at Docket Number 26 and to remand the case to the Supreme Court of the State of New York, Kings County. Plaintiff's motion for attorney's fees and costs is GRANTED. This Court retains jurisdiction solely for the purpose of acting on Pla intiff's motion for fees and costs. See Bryant v. Britt, 420 F.3d 161, 165 (2d Cir. 2005). Plaintiff's petition for fees and costs shall be filed within fourteen days of the date of this order.
