Filing 64 MEMORANDUM AND OPINION re: 61 MOTION for Leave to File supplemental Declaration or Second Amended Complaint filed by Barnabas Veraa Katuuo, The Association of The Ovaherero Genocide in the USA, Inc., Johannes Isaack, Vekuii Ruk oro, 42 MOTION to Dismiss for Lack of Jurisdiction , for failure to exhaust remedies in Germany and under the doctrines of political question and forum non conveniens filed by Federal Republic of Germany. For the foregoing reason s, Germany's motion to dismiss the Amended Complaint is granted and Plaintiffs' motion for leave to file a supplemental declaration or a Second Amended Complaint is denied. The Clerk of Court is requested to enter judgment dismissing the Amended Complaint for lack of subject matter jurisdiction and to close this case.
