OPINION AND ORDER re: 59 MOTION to Dismiss the Amended Complaint: The motion to dismiss is GRANTED with respect to plaintiff's Eighth Amendment claim against Acting Commissioner Annucci, and the First Amendment retaliation claim ag ainst C.O. Latham. The motion is DENIED in all other respects. The State represented defendants shall file an answer to the amended complaint by September 27, 2018.
