September 20, 2018	Filing 38 OPINION AND ORDER re: 21 MOTION to Dismiss filed by Gouverneur Health Care Services. For the foregoing reasons, Defendant's motion is granted. The Court has been mindful of Plaintiff's pro se status and is sympathetic to th e injuries he alleges he sustained during the course of the events at hand. Nonetheless, his claims are dismissed with prejudice because any amendment would be futile. See Singh v. NYC Dist. Council of Carpenters Benefit Funds, No. 17-CV-7159 (VSB), 2018 WL 4335511, at *4 (S.D.N.Y. Sept. 11, 2018) (denying pro se plaintiff leave to amend where it would be futile, in part because the basis for dismissal was that the claim was untimely). The Clerk of Court is respectfully directed to terminate the motion pending at docket entry twenty-one and to close the case. SO ORDERED.
