May 15, 2018 Opinion or Order Filing 75 ORDER GRANTING PLAINTIFFS' UNOPPOSED MOTION FOR CERTIFICATION OF THE SETTLEMENT CLASS, FINAL APPROVAL OF THE CLASS AND FLSA COLLECTIVE ACTION SETTLEMENT, AND APPROVAL OF ATTORNEYS' FEES, REIMBURSEMENT OF EXPENSES AND SERVICE AWARDS granting #71 Motion for Settlement. The Court Orders that: The terms of this Settlement are fair, reasonable and adequate and in the best interests of the Settlement Class. Marvelous Solano-Rodriguez is appointed as representative of the Settlement Class; Valli Kane & Vagnini LLP are appointed as Class Counsel to represent the Settlement Class under Fed. R. Civ. P. 23 and Section 216(b) of the FLSA; Class Counsel's request for Attorneys' Fees and Costs is approved; The Service Payment is approved; Defendants shall fund the Settlement in accordance with the terms of the Settlement Agreement; 53. The "Effective Date" of the Settlement shall be 30 days after the date of this Order if no party appeals this Order. If a party appeals this Order, the "Effective Date" of the settlement shall be the latest of the following, if applicable: (1) upon final affirmance of the Order or (2) final dismissal of any further petition and the time to further appeal/petition has expired. This Order shall constitute a judgment for purposes of Rule 58 of the Federal Rules of Civil Procedure. Within 25 days of the Effective Date, the Settlement Claims Administrator shall distribute the funds in the QSF by making the following payments: Paying Class Counsel one-third of the Gross Settlement Amount ($172,531.67); Paying a Service Payment to the Class Representative Marvelous Solano-Rodriguez in the amount of $2,500; Paying the Class Members in accordance with the allocation plan described in the Settlement Agreement and further explained in Exhibit A to the JND Decl. annexed as Exhibit 2 to the Kane Decl. Paying the Named Plaintiff (Marvelous Solano-Rodriguez) an additional $5,000 in exchange for his general release of claims; Paying the Settlement Claims Administrator the costs for the services of the Settlement Claims Administrator; and Paying the employer's share of any Employer Payroll Taxes as set forth in the Settlement Agreement. The Court retains jurisdiction over this action for the purpose of enforcing the Settlement Agreement and overseeing the distribution of the settlement funds. The Parties shall abide by all terms of the Settlement Agreement, which are incorporated herein, and this Order. Upon the Effective Date, the action shall be dismissed in its entirety, with prejudice. With respect to (i) the Released State Law Claims of all Class Members who have not excluded themselves from the Settlement, and (ii) the Released Federal Law Claims of all Class Members who have opted into the lawsuit or participated in the Settlement by cashing Settlement Checks or submitting a Claim Form, the Class Members shall be permanently enjoined from pursuing and/or seeking to reopen the claims that have been released pursuant to the Settlement. December 11, 2017 Opinion or Order Filing 66 ORDER GRANTING PLAINTIFF'S MOTION FOR AN ORDER PRELIMINARILY APPROVING THE CLASS AND COLLECTIVE ACTION SETTLEMENT AND CONDITIONALLY CERTIFYING THE CLASS FOR SETTLEMENT PURPOSES ONLY granting #65 Motion for Settlement. This Court hereby ORDERS that: Except as otherwise noted, all capitalized terms in this Order shall have the same meaning as set forth in the Settlement Agreement. This Court has jurisdiction over the Parties and claims and preliminarily finds that the numerosity, commonality, typicality, and adequacy requirements of Rule 23(a), and the predominance and superiority requirements of Rule 23(b)(3), have been met and that class certification for purposes of approving the Settlement is warranted; and as further set forth herein. The Court finds that the Settlement Agreement is fair, reasonable, and adequate and should be preliminarily approved. The Settlement will ensure prompt payment to Class and Collective Members and avoids the risk and expense of continued litigation. Within twenty (20) days of the filing of this Order, the Defendants will provide the Class List (including contact information) described in the Settlement Agreement to the Claims Administrator. The Claims Administrator will then mail and email the Notice in accordance with the Settlement Agreement to all Class Members. The Court will conduct a Fairness Hearing on May 15, 2018 at 11 a.m. to address: (a) whether the proposed Settlement Agreement should be finally approved as fair, reasonable, and adequate; (b) Class Counsel's application for attorneys' fees and costs; and (c) Class Counsel's application for a Service Payment to the Class Representative. In the event this Order is entered, but the Settlement is terminated 01 fails to become final for any other reason (i.e., fails to achieve its Effective Date), this Order shall be automatically rendered void and of no further force or effect, except for Paragraph 3, which shall remain in full force and effect. The parties shall publicly file unredacted copies of Plaintiffs' Unopposed Motion for Preliminary Approval of the Class and Collection Action Settlement and Incorporated Memorandum of Law and supporting papers, including the Settlement Agreement, no later than the date on which the Claims Administrator begins mailing notice of the proposed Settlement to Class Members. It is Defendants' position that any issue not required by law to be tried to a jury, including but not limited to any determination of equitable remedies, liquidated damages, or attorneys' fees or costs, is not to be tried to a jury, as those remedies and damages are to be decided by the Court. If this action is and remains certified as a class/collective action for trial, then the parties will be able to provide an estimate for the length of trial at a later date once they know the class size and scope of evidence.
