January 30, 2023 Opinion or Order Filing 241 ORDER ADOPTING REPORT AND RECOMMENDATIONS for 240 Report and Recommendations, 236 Motion for Attorney Fees filed by BMaddox Enterprises LLC, Brandon Lane Maddox. As no objections to Judge Cave's Report were filed, the Court reviews th e Report for clear error. After careful consideration of the record, the Court finds no error and thus adopts the thorough and well-reasoned Report in its entirety. Accordingly, Plaintiff is awarded $223,560.00 in attorneys' fees. The Clerk of Court is respectfully requested to terminate the motion pending at docket number 236. SO ORDERED. April 4, 2022 Opinion or Order Filing 234 ORDER: By separate Order, the Court awards Plaintiff judgment in this case consistent with the Court's rulings of August 18, 2021 and February 23, 2022. It will not, however, order third-party financial institutions to locate, attach, r estrain, or transfer Defendants' assets. In collecting its monetary judgment, Plaintiff should instead "turn to the remedies ordinarily applicable to enforcement of judgments at law under [Federal] Rule [of Civil Procedure] 69 and N.Y. February 23, 2022 Opinion or Order Filing 228 ORDER: As no objections to Judge Cave's Report were filed, the Court reviews the Report for clear error. After careful consideration of the record, including BMaddox's damages submissions, the Court finds no error and thus adopts t he thorough and well-reasoned Report in its entirety. Accordingly, BMaddox is awarded $83,568.68 in damages against the Entity Defendants as to Count 2. Consistent with the Court's August 18, 2021 order, by no later than March 9, 2022, BMaddox shall notify the Court whether it intends to proceed to trial on the remaining counts and/or with respect to damages for Count 2 against Oskouie. August 18, 2021 Opinion or Order Filing 218 OPINION & ORDER re: 200 MOTION for Default Judgment as to Defendants Platinum Avenue Holdings Pty, Ltd and Osko M Ltd. filed by BMaddox Enterprises LLC, Brandon Lane Maddox, 210 MOTION for Summary Judgment . filed by BMaddox Enterprises LLC, Brandon Lane Maddox. For the foregoing reasons, the Court grants Plaintiff's motion for summary judgment against Oskouie on Counts 1 and 2, and denies the motion in all other respects. The Court similarly grants Plai ntiff's motion for default judgment against Osko and Platinum on Counts 1 and 2, and denies the motion in all other respects. Plaintiff is entitled to $100,000 of statutory damages on Count 1. By separate order, this case is referred to Magistrate Judge Cave for an inquest into damages on Count 2, with respect to the Entity Defendants. Following the inquest into damages, Judge Cave will issue a Report & Recommendation on the appropriate award of damages for Count 2. After reviewin g that Report & Recommendation, and any timely objections made thereto, the Court will issue an Order that accepts, rejects, or modifies the findings and recommendations made therein. See 28 U.S.C. § 636(b)(1)(C). Within two weeks of the filing of that Order, Plaintiff shall notify the Court whether it intends to pursue trial on the remaining counts, and/or with respect to damages for Count 2 against Oskouie.
