Filing 132 ORDER OF DISMISSAL: This action having previously been terminated as to defendant NYP Holdings, Inc., and the attorneys for the parties having advised the Court that this action has been or will be settled as against the remaining served defendant, J oelle Gwynn, it is hereby ORDERED that this action is dismissed with prejudice and without costs to either party, but without prejudice to restoration of the action to the calendar of the undersigned if settlement is not achieved within thirty (30) d ays of the date of this Order. If a party wishes to reopen this matter or extend the time within which it may be settled, the party must make a letter application before this thirty (30)-day period expires. The parties are advised that if they wish the Court to retain jurisdiction in this matter for purposes of enforcing any settlement agreement, they shall submit the settlement agreement to the Court to be so ordered. Filing 89 MEMORANDUM OPINION AND ORDER: re: 49 MOTION to Dismiss Second Amended Complaint filed by Joelle Gwynn. For the foregoing reasons, Gwynn's motion to dismiss is granted, and the SAC is dismissed with respect to Gwynn. This dismissal is withou t prejudice to an application for leave to file a Third Amended Complaint. Any such motion must be filed by May 7, 2019, and be accompanied by a proposed Third Amended Complaint, a blackline comparison of the proposed Third Amended Complaint and the SAC, and a memorandum of law. If Plaintiff does not timely move for leave to amend, or if the motion is denied as futile, the SAC will be dismissed with prejudice as to Gwynn.
