Filing 42 OPINION AND ORDER re: 26 MOTION to Dismiss the Complaint: For the foregoing reasons, Defendants' motion is DENIED with respect to the conditions of confinement claim against Defendants Wright, Guzman, Rene and Gramozis. The motion is GRANTED with respect to all other claims and Defendants. The Clerk of Court is directed to close this motion at Docket No. 26, and to terminate the case with respect to Defendant Caputo, Defendant Ponte and the City. The Clerk of Court is also directed to mail a copy of this Opinion and Order to the pro se Plaintiff. (The City Of New York, Caputo (Warden) and Joseph Ponte (Commissioner) terminated.
