Filing 36 OPINION AND ORDER re: 27 MOTION for Summary Judgment filed by Tri-State Biodiesel, LLC, Brent Baker. For the foregoing reasons, Defendants' motion for summary judgment is GRANTED. IT IS HEREBY ORDERED THAT Plaintiff's FL SA claims are dismissed with prejudice, and Plaintiff's New York Labor Law claims and Defendants counterclaims are dismissed without prejudice.
