MEMORANDUM OPINION AND ORDER re: 17 MOTION to Dismiss . filed by EuroSite Power, Inc., American DG Energy, Inc. The motion to dismiss is granted as to Claims 1 and 2. The motion to dismiss is denied as to Claims 3, 4, and 5. Bec ause Claims 3, 4, and 5 are brought only against Defendant EuroSite Power Inc., American DG Energy, Inc. is dismissed from this action.
