ECF No. 147. Judge Netburn directed Plaintiff Roman to file a notice of pro se app earance in this action by September 10, 2021. Id. Neither the Court nor Judge Netburn has received any communication from Plaintiff Orlando Roman. Accordingly, his claims are dismissed without prejudice. August 30, 2021 Opinion or Order Filing 147 ORDER: Plaintiffs' counsel's request to withdraw as counsel for Plaintiff Orlando Roman is granted. See ECF No. 144. Plaintiff Roman is notified that if he wishes to prosecute his claims, he must file a notice of pro se appearance by Se ptember 10, 2021. Failure to file a notice will result in dismissal without prejudice of all claims. The parties are directed to file a Rider to the Settlement Agreement filed on August 2, 2021, which shall make clear that Plaintiff Roman is not in cluded in the Agreement. See ECF No. 142, Ex. 1. The Rider shall also provide a recalculation of the consideration on paragraph 4(A)(xxxiii) of the Agreement as proposed by the parties, and strike Plaintiff Roman's name from the first paragrap h of the agreement that defines him as a Plaintiff included in the Settlement Agreement. See id. The parties shall file the Rider by September 15, 2021. Plaintiffs' counsel is ORDERED to deliver immediately a copy of this order to any last known contact by mail, email, or text to Plaintiff Roman. August 23, 2021 Opinion or Order Filing 145 ORDER: Before the Court can approve the settlement as fair and reasonable, Plaintiffs' counsel is ORDERED to file a letter providing any authority to permit a lawyer to settle the claims of a party without that party's consent. Absent a ny authority, the Court is inclined to strike any settlement on behalf of Plaintiff Roman and dismiss his claims without prejudice. June 24, 2020 Opinion or Order Filing 113 ORDER: On Wednesday, June 24, 2020, the Honorable Edgardo Ramos assigned this matter to my docket for settlement. In light of the Court's busy calendar, settlement conferences must generally be scheduled at least six to eight weeks in advance. T he Court will likely be unable to accommodate last-minute requests for settlement conferences, and the parties should not anticipate that litigation deadlines will be adjourned in response to late requests for settlement conferences.
