ORDER: The Court conducted an on-the-record conference today at which plaintiff's pro bono counsel and defendants' counsel appeared in person. It is HEREBY ORDERED: 1. By February 18, 2020, plaintiff shall either move for leave to amend th e pleadings or advise the Court he does not intend to do so. 2. The next status conference is scheduled for March 5, 2020, 12:30 p.m. In the event plaintiff moves to amend the pleadings, the conference will be cancelled and will be rescheduled after the motion is decided. 3. Annuci, 23 MOTION to Dismiss (with corrected exhibits) filed by Thomas Griffin, Durla m, Frederick/Burstein, C.O. Wickham, Fox, Anthony J. Annuci. Defendants' partial motion to dismiss is GRANTED. The only claim remaining in this case is the excessive force claim arising from the incident alleged to have occurred on August 6 , 2015. Defendants Fox, Wickham, and Durland shall file an answer by September 24, 2018. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis s tatus is denied for the purpose of an appeal.
