Filing 58 ORDER OF DISMISSAL: Accordingly, under Federal Rule of Civil Procedure 41(b) and the Court's inherent power, see Link v. Wabash R.R. Co., 370 U.S. 626, 630-32 (1962), the Court hereby dismisses this case, without prejudice, for the plaintiff's failure to prosecute. The Clerk of Court is respectfully directed to close this case. (Signed by Judge Paul A. Engelmayer on 11/21/2019) (jwh) |
Filing 57 ORDER. On review of the docket in this matter, it appears that the sole remaining defendant, Readmob Technologies (HK) Ltd. ("Readmob"), was never served, and that plaintiff never filed its Rule 4(f)(3) motion, which was due November 16, 20 17. Dkt. 56. The Court therefore directs plaintiff Teri Jon Sports, Inc. to serve Readmob by November 19, 2019. If service is not completed by then, the Court will dismiss the case, without prejudice, for failure to prosecute. SO ORDERED. (Service due by 11/19/2019.) (Signed by Judge Paul A. Engelmayer on 11/12/2019) (rjm) |
