MEMORANDUM OPINION AND ORDER re: 40 MOTION to Dismiss action as against Similis Management LLC filed by Similis Management LLC. For the foregoing reasons, Similis's motion to dismiss is GRANTED. The GBL claims against bo th Defendants are dismissed. Similis is dismissed from this lawsuit. The Clerk of Court is directed to terminate the motion pending at ECF No. 40 and to remove Similis from the list of defendants in this matter. Similis Management LLC terminated.
