April 20, 2018 Opinion or Order Filing 142 MEMORANDUM OPINION AND ORDER: on re: 113 MOTION for Reconsideration re; 105 Order on Motion for Local Rule 37.2 Conference, filed by EFG Bank AG, Cayman Branch. In short, EFG fails to establish with "sufficient part icularity and specificity" that Article 271 would prohibit disclosure of the materials at issue here in the absence of a court order threatening criminal sanctions. Alfadda, 149 F.R.D. at 34. There is, of course, no such order in place here. Moreover, there is no reason to believe that the Court will impose sanctions of any kind, let alone criminal sanctions, as EFG represents that it is ready and willing to produce the materials at issue. (EFG's Br. 1 ("EFG wants nothing mo re than to complete its production of documents in this case and proceed promptly with the remainder of discovery.")). Accordingly, EFG's motion for reconsideration of the Court's denial of its request for a protective order is DENIED. The Clerk of Court is directed to terminate Docket No. 113, and as further set forth in this order. (Signed by Judge Jesse M. Furman on 4/20/2018) (ap) Modified on 4/20/2018 (ap).
