Filing 87 OPINION AND ORDER: re: 68 MOTION to Dismiss filed by Portchester Housing Authority, 78 MOTION to Dismiss filed by Kevin Munnelly, Village of Port Chester. For the foregoing reasons, the following of Plaintiff's claims are dismissed with prej udice: as set forth herein. The following of Plaintiff's claims are dismissed without prejudice: as set forth herein. The Clerk of Court is respectfully requested to terminate the pending motions at ECF Nos. 68 and 78. Plaintiff is directed to f ile a Second Amended Complaint by October 25, 2019. Failure to timely do so may result in dismissal of this action with prejudice. Finally, the Clerk of the Court is directed to mail a copy of this decision to the Plaintiff at his last address listed on ECF and to file proof of service on the docket.
