Filing 99 OPINION & ORDER re: 87 MOTION for Summary Judgment filed by City of New York, Jason Miller. Because Plaintiff has failed to set forth any facts showing that there is a genuine dispute for trial regarding his § 1983 maliciou s prosecution claim, I need not reach the questions of whether Miller is entitled to qualified immunity on this claim, or whether the City of New York is subject to municipal liability. For the foregoing reasons, Defendants' motion for summar y judgment is GRANTED. The Clerk of Court is respectfully directed to terminate the open motion at Document 87, and is further directed to close this case. The Clerk is also directed to mail a copy of this Opinion & Order to the pro se Plaintiff. SO ORDERED. (Signed by Judge Vernon S.
